The term conveyancing is used to describe the administrative and legal procedures necessary to transfer ownership (and other rights) in immovable property from one person to another.
For many people, buying or selling a house is one of the most significant transactions of their life. The concept that your estate agent is also your attorney result in the attorney performing the full range of services involved in a property transaction. This service is performed exclusively by attorneys and the commission is a mere 5%. Our lower commission percentage on the sale price is a viable proposition to the Seller.
Attorneys are legally entitled to act as Estate Agents because of the definition of an “estate agent” in the Estate Agency Affairs Act, (Section 1 of Act no. 112 of 1976): ”…does not include an attorney who, on his own account or as a partner in a firm of attorneys or as a member of a professional company who performs any act in the course of and in the name of and from the premises of such attorney’s or professional company’s practice…”
We fall under the jurisdiction of the applicable Law Society and both the buyer and seller are duly protected by the stringent rule of the Law Society. The attorney has the skills and knowledge to advise on all legal matters and can attend to the drafting of the Offer to Purchase and to all the conveyancing work flowing from the property sale.
Our services are comprehensive and include explaining the law, evaluating the property, listing the property, marketing and selling the property, negotiating the sale, transferring the property, to finally paying the seller the proceeds of the sale.
Once listed, our property experts will schedule photography and create a compelling description of your home. The listing is set up on our website and other popular sites like facebook to maximise your property’s exposure. You will be assisted every step of the way until your property is sold. We will make arrangements with you for potential buyers to view your property at times convenient to you.
Transfer fees are based on the tariff of the recommended conveyancing fees issued by the relevant Law Society, the governing body of attorneys.
